What is UK ILR?

ILR, or Indefinite Leave to Remain in the UK, means that you are not subject to immigration control and can live and work freely in the country. In terms of rights and freedoms, ILR holders are nearly indistinguishable from British citizens, although some differences do exist.

What are the differences between ILR and British citizenship?

While ILR and British citizenship are similar in terms of rights, the process of obtaining citizenship requires meeting additional conditions. To qualify for citizenship, you must have lived in the UK as a permanent resident for at least one year, with the exception of spouses of British citizens.

British citizens are entitled to obtain a second passport and participate in local elections. In contrast, ILR holders may lose their status if they are absent from the country for more than two years or if their actions are deemed a threat to national security. Citizens can leave the UK for any duration without risking the loss of their citizenship.

Who can apply for ILR in the UK?

Eligibility for ILR depends on immigration category and the grounds for application. For example, if you have legally resided in the country for over 10 years, you may apply for ILR.

Most applicants with work, business, or family visas must have lived in the UK for at least 5 years and meet immigration requirements. Certain categories of immigrants may obtain ILR after 2-3 years.

  • Main applicants and dependants holding long-term work, business, or family visas.
  • Individuals who have legally resided in the UK for over 10 years.

What are the requirements for applicants seeking ILR in the UK?

To qualify for permanent residency, you must:

  • Reside in the country on a long-term visa (usually for 5 years) or have been in the UK for over 10 years.
  • Demonstrate knowledge of the English language in one of the following ways:
  • Hold a degree from an English-speaking institution.
  • Successfully pass an English language test.
  • Pass the Life in the UK test.
  • Meet the criteria for "continuous residence" and have a minimum income (in some cases).

How to obtain UK ILR with an Innovator Founder visa?

If you arrived in the UK on an Innovator Founder visa, you can apply for ILR after 3 years, provided you meet the following conditions:

  1. Reside in the UK for 3 years, with no more than 180 days of absence per year.
  2. Successfully pass the Life in the UK test.
  3. Have an endorsement letter from an approved organisation.
  4. Meet at least two of the following business criteria:
  • Invest at least £50,000 in the business.
  • Double your client base over the past 3 years.
  • Conduct significant research and development.
  • Achieve a minimum annual revenue of £1,000,000.
  • Generate a minimum annual income of £500,000, of which at least £100,000 comes from exports.
  • Create 10 full-time jobs.
  • Create 5 full-time jobs with a salary of at least £25,000 per year.
